These Terms, together with our policies, are framed in line with the Information Technology Act, 2000, the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
1. About THROTTLEIN
THROTTLEIN is a brand owned and operated by Noseberry Private Limited (GSTIN: 09AAGCN8874N1ZG). THROTTLEIN is an online marketplace for motorcycle helmets, riding gear, parts, and accessories.
2. Marketplace nature (important)
THROTTLEIN is an intermediary / marketplace under the Information Technology Act, 2000 — it is not the seller of the products listed. Products are sold by independent third-party sellers, and the contract of sale is directly between you and the relevant seller. THROTTLEIN provides the platform that connects buyers and sellers and facilitates payments and logistics.
3. Eligibility & account
- You must be at least 18 years old and able to enter into a binding contract.
- Keep your login credentials confidential; you are responsible for all activity under your account.
- Provide accurate, current, and complete information.
4. Pricing & payment
- Prices are set by sellers, listed in Indian Rupees (INR), and inclusive of applicable taxes unless stated otherwise.
- Payments are processed securely through our payment partner; card/UPI data is handled by the gateway.
- Cash on Delivery (COD) may be available on eligible orders at the seller's discretion.
5. Orders
Placing an order is an offer to buy. A contract is formed when payment is authorised and the seller accepts the order. We or the seller may cancel an order in cases of stock unavailability, suspected fraud, or pricing errors.
6. Shipping, returns & cancellations
Delivery, returns/refunds, and cancellations are governed by our Shipping & Fulfillment Policy, Returns, Refunds & Cancellations Policy, and Cancellation Policy, which form part of these Terms.
7. Buyer obligations
You agree to use the platform lawfully, provide accurate information, and not engage in fraud, abuse, or return abuse (e.g. serial returns).
8. Reviews & user content
You may post reviews and content that is honest and lawful. No fake or incentivised reviews, no offensive or infringing content. You grant THROTTLEIN a licence to display content you submit. We may remove content that violates these Terms.
9. Prohibited conduct
No scraping, fraud, intellectual-property misuse, attempts to disrupt the platform, or unauthorised access.
10. Intermediary disclaimer & limitation of liability
Product quality, authenticity, and fulfilment are the responsibility of the seller. To the maximum extent permitted by law, THROTTLEIN is not liable for indirect or consequential damages, and our aggregate liability is limited to our role in facilitating the transaction.
11. Intellectual property
The THROTTLEIN name, logo, and platform content are owned by Noseberry Private Limited or its licensors and may not be used without permission.

13. Dispute resolution & governing law
These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Gautam Budh Nagar (Greater Noida), Uttar Pradesh, India.
14. Changes & termination
We may revise these Terms or suspend/terminate access for breach. Continued use after changes constitutes acceptance.
